2. THE DATA WE COLLECT ABOUT YOU
Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.
IF YOU FAIL TO PROVIDE PERSONAL DATA
Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). PROMOTIONAL OFFERS FROM US

5. DISCLOSURES OF YOUR PERSONAL DATA

- Specific third parties such as our distributors and/or authorised installers for the performance of the contract or services that you have subscribed for.
- Third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy.
We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.
6. INTERNATIONAL TRANSFERS
Sumitomo's regional headquarters for Asia Pacific is located in Singapore. We may share your personal data within the Sumitomo Company Group. This will involve transferring and/or storing your data outside of Singapore, your country of residence and outside the European Economic Area ("EAA")
Many of our external third parties are based outside the EEA so their processing of your personal data will involve a transfer of data outside the EEA.
If you are an EU or Swiss resident, where we transfer your personal data outside the EEA and Switzerland, this is done on the basis that it is necessary for the performance of the services or goods we provide you, or that the transfer is subject to the European Commission's model contracts for the transfer of personal data to third countries (i.e. the standard contractual clauses), pursuant to the Decision 2004/915/EC and Decision 2010/87/EU as appropriate.

7. NON-EU AND NON-SWISS DATA SUBJECT RIGHTS

You have the right to know whether we process your personal data, and if we do, to access the personal data we hold about you and certain information about how we use it and who we share it with.
Where permitted by law, Sumitomo reserves the right to charge a reasonable administrative fee for this service. In exceptional circumstances, Sumitomo reserves the right to deny you access to your personal data and may provide an explanation as required by applicable laws.
Exceptional circumstances include (to the extent allowable under applicable law) where:
- an investigating authority or government institution objects to Sumitomo complying with your request
- the information may, in the exercise of Sumitomo's reasonable discretion and/or assessment, affect the life or security of an individual; and
- data is collected in connection with an investigation of a breach of contract, suspicion of fraudulent activities or contravention of law.
Correction
You have the right to correct any personal data held about you that is inaccurate.

8. EU DATA AND SWISS SUBJECT RIGHTS
If you are a resident in the EU or Switzerland, you may have certain rights in relation to the personal data we hold about you, which we detail below. Some of these apply in certain circumstances as set out in more detail below. We also set out how to exercise those rights.

Complaints
In the event you wish to make a complaint about how we process your personal data, please contact us and will endeavour to deal with you request as soon as possible. This is without prejudice to your right to launch a claim with your data protection authority.
Access
You have the right to know whether we process your personal data, and if we do, to access your personal data we hold about you and certain information about how we use it and who we share it with.
If you require more than one copy of your personal data we hold about you, we may charge an administration fee.
We may not provide you with certain personal data if providing it would interfere with another's rights (e.g. where providing personal data we hold about you would reveal information about another person) or where another exemption applies.
You have the right to receive a subset of the personal data we collect from you in a structure, commonly used and machine-readable format and a right to request that we transfer such personal data to another party.
The relevant subset of personal data is data that you provide us with your consent or for the purposes of performing our contract with you.
if you wish for us to transfer your personal data to another party, please ensure you detail that party and note that we can only do so where it is technically feasible. We are not responsible for the security of the personal data or its processing once received by the third party. Correction

Erasure
You may request that we erase the personal data we hold about you in the following circumstances:
- You believe that it is no longer necessary for us to hold your personal data
- We are processing your personal data on the basis of our legitimate interest and you object to such processing. Please provide us with details as to your reasoning so that we can assess whether there is an overriding interest for us to retain your personal data
- You no longer wish us to use your personal data in order to send you promotions, specials offers and marketing offers
- You believe the personal data we hold about you is being unlawfully processed by us
Also note that you may exercise your right to restrict our processing of your personal data whilst we consider your request as described below.
Please provide as much detail as possible for your reasons for the request to assist us in determining whether you have a valid basis for erasure. However, we may retain personal data if there are valid grounds under law for us to do so (e.g., for the defense of legal claims or freedom of expression) but we will let you know if that is the case. Please note that after deleting the personal data, we may not be able to provide the same level of servicing to you as we will not be aware of your preferences. Where you have requested that we erase your personal data that we have made public and there are grounds for erasure, we will use reasonable steps to try to tell others that are displaying your personal data or providing links to your personal data to erase your personal data too.

Restriction of Processing to Storage Only.
You have a right to require us to stop processing the personal data we hold about you other than for storage purposes in certain circumstances. Please note, however, that if we stop processing the personal data, we may use it again if there are valid grounds under data protection law for us to do so (e.g. for the defence of legal claims or for another's protection).
You may request we stop processing and just store the personal data we hold about you where:
- you believe the personal data is not accurate, for the period it takes for us to verify whether the personal data is accurate;
- we wish to erase the personal data as the processing we are doing is unlawful but you want us to just store it instead;
- we wish to erase the personal data as it is no longer necessary for our purposes but you require it to be stored for the establishment, exercise or defence of legal claims; or
- you have objected to us processing personal data we hold about you on the basis of our legitimate interest and you wish us to stop processing the personal data whilst we determine whether there is an overriding interest in us retaining such personal data.
Objection
At any time you have the right to object to our processing of your personal data in order to send you promotions, special offers, marketing messages, including were we build profiles for such purposes and we will stop processing the personal data for that purpose. You may object where we are processing the personal data we hold about you (including were the processing is profiling) on the basis of our legitimate interest and you object to such processing.
Please provide us with detail as to your reasoning so that we can assess whether there is a compelling overriding interest in us continuing to process such data or we need to process it in relation to legal claims. Also note that you may exercise your right to request that we stop processing your personal data whilst we make the assessment on an overriding interest by indicating this in our Data Privacy Right Form
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
10. DATA RETENTION
HOW LONG WILL YOU USE MY PERSONAL DATA FOR?
We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.
To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.
In some circumstances we will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

Sumitomo takes the protection of your personal data seriously but, unfortunately, the transmission of information via the internet is not completely secure. NO FEE USUALLY REQUIRED
You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.
WHAT WE MAY NEED FROM YOU
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
TIME LIMIT TO RESPOND
We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
13. GLOSSARY
LAWFUL BASIS
Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). You can obtain further information about how we assess our legitimate interests against any potential impact on you in respect of specific activities by contacting us.
Performance of Contract means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.
Comply with a legal obligation means processing your personal data where it is necessary for compliance with a legal obligation that we are subject to.

- Professional advisers including lawyers, bankers, auditors and insurers based in the South East Asia region (including Singapore) who provide consultancy, banking, legal, insurance and accounting services.
- Our authorised services providers, including distributors and/or authorised installers based in Singapore, Australia, Vietnam, Indonesia, Malaysia, Thailand, Philippines, Sri Lanka, Cambodia, Myanmar and India to perform or provide the products and services that you have subscribed for in your respective countries.
YOUR LEGAL RIGHTS
You have the right to:
Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:
- If you want us to establish the data's accuracy.
